Intellectual Property (IP) Policy
Udyog Odisha Platform
Introduction
This Intellectual Property (IP) Policy (“Policy”) governs the ownership, use, and protection of intellectual property rights related to content, logos, and materials on the Udyog Odisha platform (“Platform”), operated by Exvion Global Pvt. Ltd. By using the Platform, you agree to comply with this Policy and applicable laws, including the Copyright Act, 1957 and the Information Technology Act, 2000.
Content Ownership
- Users retain ownership of the intellectual property rights in the content they upload to the Platform, including but not limited to product photos, descriptions, technical drawings, and other materials (“User Content”).
- By uploading User Content, you grant Udyog Odisha a worldwide, non‑exclusive, royalty‑free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and promote such content solely for the purpose of operating, improving, and marketing the Platform and related services.
- This license continues for as long as the content remains on the Platform, unless you delete it in accordance with the Platform’s procedures or we otherwise remove it.
Copyright Infringement and Notice‑and‑Takedown
Udyog Odisha respects the intellectual property rights of others and requires Users to do the same. If you believe that any content on the Platform infringes your copyright, you may submit a written infringement notice (“Notice”) to our designated Grievance Officer.
A valid Notice must include:
- Your name, address, telephone number, and email address.
- A description of the copyrighted work claimed to be infringed.
- Identification of the allegedly infringing material on the Platform (with URL or other specific reference).
- A statement that you have a good‑faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the Notice is accurate, and that you are authorised to act on behalf of the copyright owner.
- Your physical or electronic signature.
Upon receipt of a compliant Notice, Udyog Odisha will:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the affected User of the removal and the basis for the action.
Counter‑Notice Procedure
If a User whose content has been removed or disabled believes the removal was mistaken or based on a misidentification, that User may submit a written counter‑notice (“Counter‑Notice”) to the Grievance Officer.
A valid Counter‑Notice must include:
- Your name, address, telephone number, and email address.
- Identification of the material that was removed or disabled and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good‑faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your physical or electronic signature.
Upon receipt of a compliant Counter‑Notice, Udyog Odisha may, in its discretion and in accordance with applicable law, restore the removed or disabled material after providing the complaining party with notice of the Counter‑Notice and an opportunity to seek legal remedies.
Brand Protection and Trademark Usage
- The name “Udyog Odisha”, the Udyog Odisha logo, and all associated trademarks, service marks, and trade dress are the exclusive property of Exvion Global Pvt. Ltd.
- Users shall not use the “Udyog Odisha” name, logo, or any confusingly similar marks in any marketing, advertising, or promotional material without the prior written permission of the Company.
- Any unauthorised use of the Company’s branding may result in immediate suspension or termination of your account and may expose you to legal action for trademark infringement or passing off.
User Obligations and Representations
By uploading or posting content on the Platform, you represent and warrant that:
- You own or have the necessary rights, licences, or permissions to use and grant the rights described in this Policy.
- The content does not infringe any third‑party intellectual property rights or violate any applicable law.
- You will indemnify and hold harmless Udyog Odisha and its affiliates from any claims, damages, or liabilities arising from your breach of these representations.
Limitation of Liability
Udyog Odisha shall not be liable for any intellectual property infringement claims arising from User Content, except to the extent required by applicable law. Users are solely responsible for ensuring that their content and activities on the Platform comply with all relevant IP laws and regulations.
Governing Law and Jurisdiction
This IP Policy shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or proceeding arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts located in Bhubaneswar, Odisha, India.
