Prohibited & Restricted Items Policy
Udyog Odisha Bidding Marketplace
Introduction
This Prohibited & Restricted Items Policy (“Policy”) applies to all users participating in the Udyog Odisha Bidding Marketplace. It defines categories of items that are strictly prohibited, categories that are restricted and subject to additional compliance requirements, and the consequences of listing or bidding on such items. By participating in the Marketplace, you agree to comply with this Policy and applicable laws.
Zero‑Tolerance Prohibited Items
The following categories of items are strictly prohibited on the Udyog Odisha Bidding Marketplace and may not be listed, quoted, or bid upon under any circumstances:
- Narcotics, psychotropic substances, and other controlled drugs as defined under the Narcotic Drugs and Psychotropic Substances Act, 1985, or any other applicable law.
- Firearms, ammunition, explosives, and other weapons or weapon‑related items, unless expressly permitted under law and with valid licences, which are not allowed on the Platform.
- Hazardous chemicals, toxic substances, or materials that pose a significant risk to health, safety, or the environment, unless specifically authorised under law and accompanied by valid permits, which are not allowed on the Platform.
- Adult or obscene content, including pornography, sexually explicit material, or any content that violates the provisions of the Information Technology Act, 2000 or other applicable laws.
- Stolen, counterfeit, or otherwise unlawfully obtained goods, including items obtained through theft, fraud, or unauthorised duplication.
Any attempt to list, bid on, or otherwise transact in prohibited items shall be treated as a serious violation of this Policy and may result in immediate enforcement action.
Restricted Items (Subject to Licences and Approvals)
Certain categories of items may only be listed or traded if the Vendor holds valid statutory licences, registrations, or approvals and complies with all applicable regulatory requirements. These include, but are not limited to:
- Pharmaceuticals and medicinal products, which require a valid Drug License issued under the Drugs and Cosmetics Act, 1940 and related rules.
- Food and food‑related products, which require valid registration or licence under the Food Safety and Standards Act, 2006 and FSSAI regulations.
- Alcohol and alcoholic beverages, which are subject to state‑specific excise and licensing laws; listing or trading such items on the Platform is permitted only if the Vendor complies with all applicable state and central laws and holds the necessary licences.
Vendors listing restricted items must provide proof of the requisite licences or approvals upon request by the Platform. Failure to provide valid documentation or to comply with regulatory requirements may result in removal of the listing and disciplinary action against the Vendor.
Bidding Rules for Prohibited Items
- Any bid placed on a prohibited item, or on a listing that is later found to be prohibited under this Policy, shall be treated as void and unenforceable.
- The Company shall not be liable for any bids, quotations, or RFQs related to prohibited items, and no contractual obligation shall arise between the Buyer and Vendor with respect to such items.
- The Company reserves the right to cancel or nullify any bid, quotation, or RFQ related to a prohibited item without prior notice.
Enforcement and Consequences of Violation
The Company maintains a zero‑tolerance approach towards violations of this Policy.
- Any User found listing, bidding on, or otherwise transacting in prohibited items, or misrepresenting restricted items, shall be subject to immediate suspension or permanent banning of their account on the Udyog Odisha Platform.
- In addition to account action, the Company may report the violation to the relevant Cyber Crime authorities, law enforcement agencies, or regulatory bodies, as required by law.
- The Company may also preserve and disclose user information, transaction details, and other records to authorities as necessary for investigation or legal proceedings.
User Responsibility and Compliance
Users are solely responsible for ensuring that the items they list, bid on, or purchase comply with this Policy and all applicable laws, including but not limited to the Information Technology Act, 2000, the Narcotic Drugs and Psychotropic Substances Act, 1985, the Drugs and Cosmetics Act, 1940, the Food Safety and Standards Act, 2006, and state‑specific excise and licensing laws.
Users must not circumvent this Policy by mislabelling, misrepresenting, or obscuring the nature of prohibited or restricted items.
Amendments and Updates
The Company may update this Prohibited & Restricted Items Policy from time to time to reflect changes in law, regulatory requirements, or Platform practices. Users will be notified of material changes through the Platform or by email, and continued use of the Marketplace after such notice shall constitute acceptance of the revised Policy.
